Terms of Service

1. Acceptance of Terms

By signing up for, accessing, or using any service provided by Found Revenue ("we", "us", "our"), you ("Client", "you") agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a business, you represent that you have the authority to bind that business. If you do not agree to these Terms, do not use our services.

These Terms form a binding agreement between you and Found Revenue, operated out of Kelowna, British Columbia, Canada.

2. Service Description

Found Revenue provides AI-powered business automation services, including:

  • AI Voice Agents — Outbound and inbound automated calling powered by Retell AI and Twilio, configured to represent your business.
  • Automated Email & SMS Outreach — Sequenced, personalized email and SMS campaigns sent on your behalf via Resend and Twilio.
  • n8n Workflow Automations — Custom business automation workflows built and hosted on Found Revenue's managed infrastructure.
  • Client Dashboard — A web portal to monitor campaign performance, call activity, and automation status.

Services are configured based on information you provide in your onboarding intake form and remain active for the duration of your subscription.

3. Payment Terms

The following billing schedule applies when you sign up:

  • At Signup (Day 0) — A one-time setup fee is charged immediately to the payment method on file. This fee covers the build, configuration, and activation of your automation. Your 14-day free trial begins at this point.
  • Day 14 — Your first monthly subscription payment is automatically charged. Monthly billing continues on the same date each month until you cancel.

All fees are charged in Canadian dollars (CAD) unless otherwise stated. Payments are processed securely through Stripe. By providing your payment information, you authorize Found Revenue to charge the applicable fees as described above.

Setup fee refund policy: The setup fee is non-refundable once your automation build has commenced (typically within 48 hours of signup). If you cancel before any build work has begun, please contact us promptly at ayden.t@foundrevenue.co.

4. Cancellation Policy

You may cancel your subscription at any time. There are no long-term contracts or cancellation penalties.

  • Cancel any time before Day 14 to avoid the first monthly subscription charge.
  • If you cancel after the monthly subscription has begun, your access continues until the end of the current billing period. No partial refunds are issued for unused days.
  • To cancel, email ayden.t@foundrevenue.co with your account details. We will confirm cancellation within one business day.

Upon cancellation, your automation workflows will be deactivated at the end of your billing period. You may request an export of your data within 30 days of cancellation.

5. Client Responsibilities

As a client of Found Revenue, you agree to:

  • Provide accurate, complete, and up-to-date business information in your intake form and throughout the service relationship.
  • Ensure that any contact lists, phone numbers, or email addresses you provide to Found Revenue for outreach purposes have been collected lawfully and with appropriate consent under applicable Canadian law, including CASL (see Section 6).
  • Use Found Revenue's services only for lawful business purposes. You must not use our services to harass, defraud, impersonate, or harm any individual or organization.
  • Comply with all applicable laws and regulations in your jurisdiction relating to electronic communications, telemarketing, privacy, and consumer protection.
  • Promptly notify Found Revenue of any known or suspected misuse of your account or credentials.

6. CASL Compliance

Canada's Anti-Spam Legislation (CASL, S.C. 2010, c. 23) governs commercial electronic messages sent from or within Canada. Both parties have obligations under CASL.

Found Revenue's obligations: When conducting outreach on your behalf (emails, SMS, automated calls), Found Revenue will configure and deploy messaging that is structured to comply with CASL, including providing functional unsubscribe mechanisms and appropriate sender identification.

Your obligations: You represent and warrant that all contact lists provided to Found Revenue consist only of individuals who have given express or implied consent (as defined under CASL) to receive commercial electronic messages from your business. You are solely responsible for the legal basis of your contact data. Found Revenue relies on your warranty of consent and is not liable for CASL violations arising from non-consensual contact lists you provide.

Unsubscribe requests received via any Found Revenue-managed channel will be honored within 10 business days, as required by CASL.

7. No Warranties

Found Revenue's services are provided "as-is" and "as available". We do not guarantee specific results, including revenue increases, lead generation outcomes, call answer rates, or any other business metric. AI systems — including voice agents and language models — may produce errors, unexpected outputs, or temporary service disruptions.

To the maximum extent permitted by applicable law, Found Revenue disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Found Revenue shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost profits, lost data, or business interruption, arising from your use of or inability to use our services.

In all cases, Found Revenue's total cumulative liability arising out of or related to these Terms or the services shall not exceed the total fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

9. Intellectual Property

Your data: You retain full ownership of all business data, contact information, and content you provide to Found Revenue. Found Revenue does not claim any ownership over your data and will use it solely to provide the services described herein.

Found Revenue's platform: Found Revenue retains all ownership rights in its platform, software, automation framework, workflows, templates, and infrastructure — including any custom configurations built for your account. Upon subscription termination, Found Revenue's proprietary components are not transferred to you.

10. Termination by Found Revenue

Found Revenue reserves the right to suspend or terminate your account immediately if you:

  • Violate any provision of these Terms
  • Use the services for illegal, fraudulent, or abusive purposes
  • Violate CASL or other applicable privacy or anti-spam laws
  • Fail to pay amounts owing after reasonable notice

In the event Found Revenue terminates your account for cause, you will be given the opportunity to export your data within 14 days of termination notice, subject to any outstanding obligations.

11. Privacy

Your privacy matters to us. How we collect, use, and protect your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy.

12. Dispute Resolution

If a dispute arises between you and Found Revenue, we ask that you first contact us at ayden.t@foundrevenue.co to attempt to resolve the matter informally. We will make good-faith efforts to negotiate a resolution within 30 days of receiving written notice of a dispute.

If informal negotiation is unsuccessful, disputes will be submitted to the exclusive jurisdiction of the courts of British Columbia, Canada.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, business practices, or applicable law. We will notify active clients by email at least 14 days before material changes take effect. The updated Terms will also be posted on this page with a revised "Last updated" date.

Continued use of the services after the effective date of changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your subscription before the changes take effect.
